Employment & Labor

Silver & Freedman’s Employment & Labor Law Department represents management in all phases of employer/employee relations, including administrative hearings and litigation. Our attorneys defend employers against lawsuits filed in state and federal courts by employees for wrongful termination, sexual harassment, discrimination, breach of employment contracts, wage and hour violations and other employment-related claims. The Employment & Labor Law Department also defends employers who have been charged by state or federal government agencies for possible violations of labor and employment laws, such as wage and hour laws and employment discrimination laws.

The risk of costly litigation can be substantially reduced when employers think before they act; therefore, our attorneys spend substantial time counseling employers in the following areas:

  • Recruitment and hiring
  • Discipline and termination
  • Wage & hour laws
  • Workers’ compensation and unemployment insurance statutes
  • Harassment and discrimination
  • Americans with Disabilities Act (ADA)
  • Compensation and strategic planning
  • Occupational safety and health

We also work with employers to draft and implement employment documentation, employee handbooks,  supervisor manuals, confidentiality agreements, non-competition agreements, and severance agreements; to set up and maintain evaluation, discipline and termination procedures and documentation; and develop and maintain personnel files.  

The Employment & Labor Law Department conducts both on-site and online management and supervisory training programs on such diverse topics as sexual harassment (in compliance with AB1825), wage and hour administration, reduction of workers’ compensation costs, and the interviewing, hiring, evaluation, discipline and termination of employees. 

Additionally, we assist employers faced with union organizing activity.The Employment & Labor Law Department represents employers in collective bargaining negotiations.  We also represent employers charged with unfair labor practice conduct before the National Labor Relations Board.
