Decision Postponed in Brinker v. Superior Court
Decision Expected no later than April 12, 2012

 

The California Supreme Court has extended its deadline for issuing a final decision in the ongoing legal battle of Brinker v. Superior Court

 

The decision, which will have a major impact in determining how employers must handle meal and rest breaks, was originally anticipated no later than February 6, 2012 (90 days from the date of oral argument).  However, due to an unusual step of allowing the parties in the case to submit additional briefs on an issue raised during the November 8 oral argument, the court vacated its previous order and said that the case will be “resubmitted” on January 13, 2012.

 

A final decision is expected no later than April 12, 2012 (90 days from the resubmission date).
